These Terms and Conditions (“Terms”) govern your access to and use of all services, programs, materials, and digital platforms provided by Independent Pathways LLC (“Independent Pathways”, “we”, “us”, or “our”). By accessing our website, using our services, or participating in our programs, you agree to comply with these Terms.
1. Use of Services
Our services are intended for personal, non-commercial use unless a separate written agreement exists. You agree to use them only in ways that comply with applicable laws and these Terms. Unauthorized use- including but not limited to, misuse, duplication, reproduction, resale, redistribution, reverse engineering, or disruption of our services, is strictly prohibited.
2. Intellectual Property and Limited License
All materials provided by Independent Pathways—including digital files, training modules, written content, audio, video, interactive courses, and downloads (“Materials”)—are protected by copyright and other intellectual property laws. When you access these Materials, you are granted a limited, non-exclusive, non-transferable, revocable license to use them for personal use only, unless a specific written agreement provides otherwise. You may not reproduce, distribute, share, sell, modify, record, or otherwise exploit any content, without our express written permission. Unauthorized use will result in termination of access and may result in legal action.
3. Online Platform Access and Subscriptions
Independent Pathways offers subscription-based access to digital content through a secure web platform. Subscriptions may be, per module, monthly, or annual, with access to training and self-paced courses. Login credentials are personal and may not be shared. We may monitor usage to detect unauthorized access and suspend accounts if abuse is detected. Content is streamed-only unless otherwise noted. Subscription fees are non-refundable unless expressly stated. We reserve the right to modify content, pricing, or features at any time.
4. Comprehensive Sexuality Education Across the Lifespan: A Diverse Abilities Approach Curriculum
The Comprehensive Sexuality Education Across the Lifespan: A Diverse Abilities Approach (“Curriculum”) is the exclusive intellectual property of Independent Pathways LLC. All materials-including digital files, training modules, written content, audio, video, interactive courses, and downloads (“Materials”)—are protected by copyright and other intellectual property laws. 5. Educational and Coaching Services
Independent Pathways provides coaching and support services, including training, consulting , and skill development. Our coaching and educational services are intended for general guidance and support. They are not medical, psychological, or legal services. Independent Pathways does not diagnose or treat any condition. Users are responsible for seeking appropriate licensed services when needed. Confidentiality is respected, but absolute confidentiality, particularly over digital communications, cannot be guaranteed.
6. Social Gatherings and Events
Independent Pathways facilitates social and community events for adults (18+). We do not monitor or control attendees and make no representations about their behavior. Events may occur in third-party venues, which we do not own or control. We are not responsible for the safety, accessibility, or condition of these spaces. Participation is voluntary and at your own risk.
7. Divergent Dating Program
Divergent Dating is a program for neurodivergent adults seeking to build social connections. Participation is voluntary and limited to individuals 18 or older. Independent Pathways does not conduct background checks, monitor interactions, or guarantee any outcomes. We are not responsible for participant behavior and do not make any warranties related to dating success or interpersonal relationships. Events may occur at third-party locations. Attendees assume all risks related to participation. Inappropriate conduct may result in removal from the program at our discretion.
8. Disclaimers
a. No Professional Licensure Implied
Unless explicitly stated, Independent Pathways is not licensed as a provider of psychological, psychiatric, legal, medical, or therapeutic services. Our services are for educational and support purposes only.
b. No Legal, Medical, or Financial Advice
We do not provide legal, medical, therapeutic, or financial advice. Any support or content offered should not be used as a substitute for licensed professional services.
c. No Guarantees of Outcomes
We do not guarantee specific results or outcomes from any of our services, programs, or materials. Individual results will vary.
d. Limited Support for External Organizations
While we may express support for certain causes or collaborate on events, such involvement does not imply endorsement or partnership with third-party organizations. Support is limited to specific initiatives or issues, not the organization as a whole.
9. Payment and Refunds
Payment terms will be communicated at the time of booking or purchase. All fees are final unless otherwise noted. We reserve the right to cancel or modify services at our discretion.
10. Indemnification
You agree to indemnify and hold harmless Independent Pathways and its staff, affiliates, and agents from any claims, damages, or expenses arising from your use of our services, your participation in programs or events, or your violation of these Terms.
11. Limitation of Liability
Independent Pathways shall not be liable for any indirect, incidental, or consequential damages resulting from your participation in services, access to content, or attendance at events. All services are offered “as is,” and we disclaim all warranties to the extent permitted by law.
12. Modifications to Terms
These Terms are a living document and may be updated from time to time to reflect changes in our services or legal obligations. We will post revised Terms on our website with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. It is your responsibility to review them periodically.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Indiana. Any disputes will be resolved exclusively in the state or federal courts located in Hamilton County, Indiana. You consent to the jurisdiction of those courts.
